Dayton restaurant owner faces more felony charges, prosecutor says
Eva Christian, the owner of Boulevard Haus restaurant in Dayton who was indicted in March on four felony counts related to alleged insurance fraud, may face additional felony charges within the next week, according to Montgomery County prosecutors.
In a court filing opposing Christian’s attempt to end the electronic home detention requirement of her bond, assistant Montgomery County prosecutor Sarah Schenck wrote that prosecutors have “every intention of re-indicting this defendant for further felony charges” and that Christian “is aware of that fact,” which increases the risk of the restaurant owner fleeing before trial.
Christian “has an outstanding passport that she claimed to have been stolen in the burglary she arranged to collect insurance money,” Schenck wrote.
In his motion to relax the electronic home detention restrictions on his client, Christian’s attorney, John D. Smith of Springboro, said, “There is one passport, and that has been turned over” to prosecutors. Christian “is not and has never been a flight risk,” Smith’s motion said.
Prosecutors did not detail what additional charges Christian might face. In a June 8 court hearing, testimony and a search warrant suggested that investigators believe Christian staged a December 2009 gunman’s attack at her Washington Twp. home in addition to the two burglaries that form the basis of the charges of insurance fraud and making a false report.
Christian reported a burglary at her home on Saint Laurent Circle in the early hours of Oct. 11, 2009. She also reported a burglary and vandalism at a restaurant she owned, Cena, after the Miami Twp. restaurant closed on Christmas Eve, 2009. The restaurant never re-opened.
