Feds declare Cheerios a drug

The Food and Drug Administration has told General Mills that if the company is going to tout its iconic cereal Cheerios as “proven to lower cholesterol,” it should be forced to gain approval of Cheerios as a drug, according to this FDA “warning letter” to General Mills CEO Ken Powell dated May 5.

And if it doesn’t, the FDA threatens to seize the cereal.

An FDA review of Cheerios’ labeling “found serious violations of the Federal Food, Drug, and Cosmetic Act” and suggests Cheerios could be considered an “unapproved new drug,” the warning letter says.

Here’s an excerpt from the warning letter:

Based on claims made on your product’s label, we have determined that your Cheerios Toasted Whole Grain Oat Cereal is promoted for conditions that cause it to be a drug because the product is intended for use in the prevention, mitigation, and treatment of disease. … These claims indicate that Cheerios is intended for use in lowering cholesterol … . Additionally, the claims indicate that Cheerios is intended for use in the treatment, mitigation, and prevention of coronary heart disease through, lowering total and “bad” (LDL) cholesterol.
… Failure to promptly correct the violations specified above may result in enforcement action without further notice. Enforcement action may include seizure of violative products and/or injunction against the manufacturers and distributors of violative products.

General Mills responded to the FDA letter with an online statement that noted its heart-health claim has been approved by the FDA for more than a decade. Here’s the cereal-maker’s statement:

Cheerios’ soluble fiber heart health claim has been FDA-approved for 12 years, and Cheerios’ “lower your cholesterol 4% in 6 weeks” message has been featured on the box for more than 2 years. The science is not in question. The scientific body of evidence supporting the heart health claim was the basis for FDA’s approval of the heart health claim, and the clinical study supporting Cheerios’ cholesterol-lowering benefit is very strong. The FDA is interested in how the Cheerios cholesterol-lowering information is presented on the Cheerios package and website. We look forward to discussing this with FDA and to reaching a resolution.

There are serious issues involved here, to be sure, but can you envision federal agents raiding a Cheerios plant and seizing boxes of cereal?

Folks: It is well worth remembering that the FDA is the most pervasive drug cartel in the nation; that the goal of every cartel is control. The absolute last thing they are interested in is “healthcare.” The name of the game, people, is “disease care.” Nothing pisses them off more than anything that smacks of a natural, common sense remedy. So keep poppin’ those pills, for Godsakes.

I can’t believe that Cheerios is sparking all this political talk! It’s a breakfast cereal and a healthy snack,not a drug. I grew up on Cheerios and if eating it helps me have better health, kudos to General Mills. The FDA needs to butt out on this one.

It’s amazing how many people can completely miss the point! The FDA is trying to get the manufacturer of Cheerios to prove what they claim. This in no way limits what we can buy and eat. This is exactly what the FDA should be doing: ensuring that companies prove what they claim because consumers don’t have the time and/or knowledge to do that.

The point FDA is making is that it is not permissible to make claims of medical benefits of Cheerios to influence the the public’s choice. If not controlled anyone can make any clkaim and get away with it.

Hating???? Who is hating? I didn’t expect for President Obama to come into office and fix anything. I expected President Obama to come into office and do exactly what he’s been doing. Taking things from the hard working and giving them to those who refuse to help themselves. He is creating the Dems long awaited social government machine. The FDA letter states the “Intended Use” is to lower cholesterol. I thought the “Intended Use” was for a good hearty breakfast. I have never received a prescription from a doctor to eat Cheerios to lower my cholesterol, it is just an added benefit to an excellent product. They should be able to advertise that if it has been clinically proven. If not, they just need to reference the results in their marketing. If Cheerios is considered a drug, them Kix is my wife’s “crack” because she’s hooked on it. Get real FDA!

When have Cheerios ever hurt anyone?? I ate cheerios after my high cholesterol test for 2 months and my cholesterol did go down by 5%!!!! I don’t know if that was the only thing, but I am sure it played a part. It isn’t about a drug, it is about eating healthy. And maybe common sense should play a part here? I am sure every American knows that cereal isn’t a drug. I supposed if we get pulled over and ate cheerios for breakfast we would get a DUI. Seriously, don’t we have more important things to worry about?

the FDA allows the importation from china of fish raised in raw sewage, & the administration of hormones to our food animals; also, because it is considered a ‘toy’ and not ‘cosmetics’ children’s make-up is not regulated and the manufacturers of toy make up can use ingredients that are forbidden in cosmetics. all of that is ok. but let Gen’l Mills state that Cheerios are a heart healthy food and they are railroaded. Who at the FDA got paid off by the drug companies for this nonsense?

Does this mean that those “healthy” grains that the health food stores sell will have tags showing their FDA approval also?? Big brother never ceases to amaze me, even at this late date in my life. Has the FDA ever heard of the “holistic approach?” The effect a food can have on our health does not indicate that it is a drug anymore than fiber in an apple makes the apple a laxative! When are the American people going to say; “enoughs enough!” There are many benefits to different food stuffs. That doesn’t make them drugs. I fear this is a continuing process of egregious regulatory acts to protect the interest of Pharma companies. While medical costs are skyrocketing and the calls for government intervention by the government into the medical industry — it is very telling about their attempts to squash this low cost, low side affect avenue of self-guidance through diet. God’s chosen person, Margaret Hamburg, who heads up the FDA is well connected to those who have no love for us sheep…or should I say cattle. So now we’ll need a perscription to buy Cheerios…absurd! Trying to look at this rationally (admittedly hard to do), what I am coming up with is the difference between Cheerios reducing cholesterol because of an effect it has on the body (the way Lipitor or other drugs have an effect on the body) or because it is an improvement in diet. If the former, this is not as nutty as it sounds. If the latter, it is like saying that an exercise program is a drug because it helps reduce cholesterol and blood pressure.

Come on, FDA, GET REAL! Yes, there are some food items out there that actually improve your health, and are NOT considered drugs! Instead of nitpicking and wasting your time and money (virtually, the taxpayers money) why don’t you spend your efforts on something worthwhile…say…taking aspartame (Nutrasweet) off the market, since you had thousands of complaints of ill effects from this additive since it’s inception. Leave my Cheerios alone!

All of the herbal stuff on shelves of every store and the FDA is giving Cheerios a hard time…Maybe they should be monitoring the foods coming to the USA from overseas instead of worrying whether if it lowers Cholesterol, it is a drug! Cheerios’s must work better than the leading cholesterol lowering drug Lipitor which has very dangerous side effect. Makes the hamstring muscles weak therefore your legs give out and you start to falldown. The FDA will shut down this cereal if it effects drug sales. The chain of events has begun this is no mistake watch your government at Work. What about the vitamin & bottled water companies labels, promises?

Government waste and abuse at it’s most asinine. There is a difference between the letter of the law and the intent of the law. The FDA is being Pharisaical in pointing out Cheerios’ minor violations and even threatening to seize the cereal. Congress should look into how the FDA is running their affairs. This isn’t funny to me at all. It’s unnerving.

Hilarious. I thought that this was from the “Onion” web site but I guess its real. I guess the FDA has nothing better to do. IF I were them I would raid the Honey Nut Plant first because they taste better!!!
